    Hello

    I hope you can help.
    I drove in the early hours of the morning along a main 30 road coming off a 50 road in wet conditions and hit a very large pothole.

    This resulted in a burst front right tyre and I needed to get roadside assistance and a new tyre.

    I took photos and submitted a claim via the council website but they have denied my claim saying they have inspected the road quarterly so are not to blame even though the pot hole was known.

    Any ideas how to appeal this successfully?

    This is what they have written
    "It is not always the case that someone is to blame as a result of a defect being present and does not automatically make the Council, as the relevant Highway Authority for Hertfordshire County Council liable for any damage sustained as a result of it. For a claim to be successful it is necessary to show that the Council has failed in its duty to maintain the highway
    The Highways Act 1980 requires that as the Highway Authority, the County Council maintain all roads under its jurisdiction. Inspections are therefore carried out at regular intervals, although the frequency depends upon the type of road. After checking with our highway records we can advise that at this location, inspections are carried out Quarterly.

    All statutory inspections of the location have been undertaken; most recently the inspection undertaken before your incident took place on the 10/11/2025.

    Hertfordshire Highways operates a robust maintenance policy and is responsible for managing and maintaining one of the busiest networks in the country. Further information regarding Hertfordshire County Councils Highway Maintenance Policy can be found on our website www.hertfordshire.gov.uk (defect management approach).

    In view of the above we consider that the County Council has complied with our statutory duty as laid down in the Highways Act of 1980 (Section 58) and do not consider that there has been a breach of duty. Given the above, I am unable to offer the compensation that you have requested. "

    To be successful in a claim against an authority which hides behind section 58 of the Highways Act 1980 you need to challenge the adequacy of their system for inspection and repair.

    You say the pothole was known.
    By that do you mean it had already been reported to the Highway Authority(HA)?
    If so when? and do you have proof of the report being made?

    How long had the pothole been present?
    Was it present at the last HA inspection? (you'll need to obtain a copy of the HA's inspection log)

      Hello thanks for your response. On their pothole tracker website it was known for a while but it doesn't give details in terms of size etc or plan to fix.
      Would you suggest a foi request regarding the pothole to get these details?

      I attached it for reference in terms of size as it's massive

          Thanks, what would the foi need to show for this to be a successful appeal?
          The website tracker says it was last inspected 19.12.25 and I hit it 12.1.26. Council email response suggests last inspected in 10.11.25

              I won one on behalf of my daughter as the council said they were aware of it and it had been inspected which dug their grave. Go back to the original legislation and see what they have to do if they are aware of it. I quoted this at them (it was not coned off or marked in any way) and they backed off and paid out for the tyre.

                I understand Herts CC are reluctant to pay out pothole damage claims

                I would be sending a FOI request for:
                i) inspection records and maintenance reports for that road for the 12 months prior to your event
                ii) a log of all repairs carried out on that road for the 12 months prior to your event
                iii)a copy of their current Highways Maintenance Policy/Inspection Manual".
                iv)copies of any reports or complaints received regarding your specific pothole in the 3 months prior to your event

                You will then need to see if they have failed to act in accordance with their own policy.
                Were your photographs of that pothole taken with a ruler showing lengthy, breadth and depth.? (if not take some now if it has not been filled!)

                  The council I claimed from actually sent me the inspection info to prove they were not liable! It was actually evidence against them.
