  • Another vehicle collided into me, turns out my insurance had expired, how to proceed?

    Hey there,

Not sure how to begin here. Driving for almost 20 years no issues no points no accidents etc.

A vehicle collided into me, causing significant damage to my vehicle, possible write off (all cosmetic but that’s just insurance for you)

I found out quickly afterwards that my insurance had expired a few days prior and the new policy I had taken out with another provider started the following day (my error)

As I have no policy in place, how do I go about dealing with the other parties insurance company? I have never been in an accident before so I have no idea how to deal with this issue as I have never dealt with insurance companies before.

Should I reach out to themas the registered keeper/owner of the vehicle or as the driver of the vehicle? What would be my best course of action to minimize my exposure as much as possible? I have a suspicion they will attempt to take full advantage of me knowing I have no legal body fighting in my corner.

All the advice I can get is appreciated,

    many thanks!

Was the third party fully responsible for the collision?
If so have they admitted liability?

If not, are they claiming against you?

      Hi, thanks for the reply.

They attempted to blame me by yelling and shouting but I ignored them and just started filming. They changed their story at least 3 times on the side of the road (on video)

Just a quick recap. We are in a 3 lane roundabout, I am in lane 1 and in the correct lane to take a single lane exit, all other lanes lead to dual carriage ways. They are in lane 2. As I am slipping off into the exit, they change from lane 2 directly into me. My damage is from the middle of the drivers door all the way to the rear door (but nothing else) The damage they sustained was their left front bumper, left alloy wheel which was pushed into the engine bay, and also their left passenger door was smashed up.

They blamed me all the way to the sun with many changes in their story. I have video footage of damage on both cars and the fact that we are in a single lane exit. It should be difficult for them to argue any story at this point, but nothing will surprise me as I now have no insurer on my side to fight for me.

All the help I can get is appreciated.

I think you should obtain proper legal assistance.

From your brief description, assuming you have no independent third party witness and there was no personal injury, I would anticipate the third party insurer would normally negotiate with your insurer with a view to each insurer covering their respective insured's losses.
As you have no insurer they may well try and recover from you.

On the other hand as you consider the third party responsible for your losses, you could claim against them.

This could well end up in county court, hence you should seek out a solicitor at least for an initial consultation.

There is also the matter of driving whilst uninsured.
If the police are informed you will be up begore the magistrates and for that the penalty is £300 fine and 6 penalty points on your licence.

Tagging PallasAthena (who I believe was in insurance more recently than I and will be more up to date)
