  • Red Light Offence Looks like its going to court

    Hi All, Really need some advice / help.

    I have been driving for 15 years and have a clean licence with no points i work in the motor trade so my licence is essential to keep my job, If i get 6 points or more i wont be able to be insured so will loose my employment equally if i get any form of ban it will be the same, My household depends on me working to provide for my partner who is a career for her disabled mum who lives with us and we have two children both with proven additional needs as the sole income generator of the house hold loosing my employment would cause so much damage to the household.

    Back in July i received a letter for contravene a red traffic light nip which i sent back as i was driving as i was, I remember the incident it was a Single lane bridge i had been waiting at the red light and for some reason i went over it i am sure the red light went off but cant recall seeing a green light ( i know this is not a valid defense but it is genuine) going over the bridge i saw a car coming the other way to my horror i believe the other car had jumped the light as did my partner who was in the car with me) i remember flashing them as i believed he jumped the light and there was enough room for us both to get through so we passed and didnt think much more of it.

    I have not heard anything back from the police so i called them and asked if they had received my letter saying i was the driver they said yes but cant discuss any further as it has been refereed to court. They wouldn't tell me what for?

    The original NIP says contravene a red traffic light signal After googling online ( worse thing to do i know) i am concerned the charge might have changed to something like careless or dangerous driving which will have a massive impact to my licence. I know the bridge has no cameras so could only be by dash cam i have been reported. If it was the car behind me at the lights it will only show me driving through a 'red' light although hopefully it might show the light glitched however if it was the other car its going to look like i was driving at him flashing him. I am deeply concerned as this really was a strange and unfortunate situation. Any advise would be greatly appreciated.

      He's already done that and been told that no advice can be given until he knows what he's been charged with.

      From the description it is unlikely that the result will be six points or more, even if careless driving is charged. Dangerous Driving can be completely ruled out (again, based on the description provided).

          Hiya finally have got my SJPN, on the front page it says you have been charged with : Driving offences .

          the charge sheet has

          (1) drive in a road other than a motorway fail to comply with red green arrow lane closure light signal 06/07/2025 — drive on a road other than a motorway fail to comply with red green arrow closure light signal h20370 legislation contrary to section 36 1 of road traffic act.

          i am worried that as it says drive on a road other than a motorway twice is it 2 offences ?

          it was a red traffic light ?

          the bit that says your plea

          has one option

          offences charged

          drive on road other than motorway fail comply with red green arrow lane closure/ lane closure signals and 2 options are guilty or not guilty

          what am I doing?

          what will be the charge if i plead guilty is it just 3 points will i get a driving ban

          I can’t be bothered to contest it if its only 3 points any help advise will be great

            The offence carries three points only - no more, no less. The wording of the charge on the SJPN seems clumsy, that's all.

            Whilst the court has the option to impose a ban instead of points for any offence which carries an endorsement, there is absolutely no reason to believe they will do so.

            The reason it went to court instead of course or fixed penalty being offered is probably because he "time into red" was excessive.
