  • MIB claim

    Hi I recently recevied a letter from DWF law, acting for thier client Motor Insurers Bureau, regarding a vehicle collision in 2017 , i was uninsured at the time and in court pleaded guilty to careless driving, i was banned from driving for 3 years with a £2.000. fine that i paid over the following year. they are demanding £10 000 .
    they ask me reply in 14 days, do you have any advice

    It maybe that the claim is Statute Barred, they need to make a claim within 6 years.
    Have you had any other documentation between 2018 and 2025?

    Send the following letter, make sure you get Proof of Postage.

      If you cause injury or damage in a road traffic accident and the accident is your fault but you are uninsured then you are personally liable to compensate the other driver for the injury or damage rhey suffered.

      The procedure is that a statutory organisation called the MIB pays the third party and then recovers it from the uninsured driver.ie you in this case.

      That seems to be what is happening here.

      I can't comment on the accident as we know nothing about it but as you were convicted of careless driving it's likely that you are obliged to pay compensation to the MIB. If you think you have a defence you would need to consult a specialist solicitor.

      I assume this isn't the first time that MIB have been in contact with you about this. Normally they would only pass to DWF if their previous request for payment had been ignored.
