UKPS PCN

Hi all members

Last week I received a PCN in the post from UKPS limited for entering a private car park. I was gone for about 7-8 minutes. The PCN has the time 14:22 and a photo of my vehicle entering and leaving the car park but shows only one time. I appealed and asked if the time is for entrance or exit. The photos have no date,or time stamp. I appealed and requested documents where permissin was granted for the lanlord to turn the land into a car park and, also requested a document showing permission granted for UKPS limited to work on the land. A further request was made for a Calibration maintenance and adjustments record. UKPS limited have not disclosed anything and gave no reason why.
I received a reply saying my appeal is unsuccessful and that it was issued correctly. The PCN letter states the car park location as in Derby Road, Stapleford, Nottingham.

I did some research and found that the car park is not in Derby Road. It is in a side street, Broadoak drive, Stapleford, Nottingham. The entrance and exit to the car park is in Broadoak Drive, Stapleford. The only car park In Derby Road, Stapleford town stretching for more than1 mile is council owned. (I have replied to UKPS limited for the documents as requested and I have challenged them to prove the car park in question is in Derby Road, Stapleford, Nottingham. I have photographic and written evidence (Local paper) that shows the car park is not where UKPS limited say it is.
They have also installed the ANPR camera adjacent to a wall of an empty building that is not owned by their client land owner. Am I correct in asking for the requested documents and ANPR calibration and maintenance certificate and do they have to supply the documents I requested.
My Brother fought 97 PCN's in private car parks and won all 97 but can't remember if he dealt with UKPS limited however, he did say UKPS limited are a cowboy company.

UKPS aren't interested in any appeal you make to them, and quite frankly making an appeal to IAS is a further waste of time.

I suppose you identified yourself as the driver when you appealed to them.

I would now sit back and await a Letter of Claim from their tame solicitor before disputing the charge.
It will probably reach the point of a court claim being issued, and you presenting a robust defence before they probably/possibly discontinue the case

I have NOT revealed my identity. In my appeal I stated that I am the owner not the driver as shown in their PCN. Owner. I've been reading the BPA code of practice on line and it seems UKPS are not abiding by their rules. My Brother said they use Gladstone solicitors who have lost more cases than I've had hot dinners. He can't remember the other 2 firms.

Glad to see you haven't identified the driver (the most common mistake made by victims of these parking companies)

UKPS are members of IPC, not BPA, however operators from either organisation are supposed to be operating under a single Code of Practice from February 2025.
However there is a cop out in so far as the Code permits a period of transition in relation to existing sites and signs where accredited trade association members will be required to meet the new standards in full by 31 December 2026.

Good afternoon DES8 I have been reading the IPC code of practice. The UKPS has not shown the date and time stamp on the PCN. They have also not stated the length of time the vehicle was in the car park for including a grace period. I think the none date and time stamp is good enough for me to refuse paying the fine.
It's an open land, no name of the car park, no name of it's location.

I'll wait now for the operators next letter. I'll keep you informed.
