  • Car repair not completed

Hi everyone, I will try and make this as clear as possible. Basically on 14th November 2023 my Mercedes engine seized on the motorway and was retrieved to my local garage who could not carry out the repair. I went on to a Mercedes Facebook group to ask if anyone had an engine for my car so I could get it swapped into mine. I was contacted by a guy who said he could fit an engine into my car if we both looked for a suitable one. A short while later he said he had found a car for sale with the correct engine and asked me to come and check it out. So I arranged to meet him where the doner car was, its quite a long way from me, 3 hrs drive. I met him there and we heard the car running and all seemed fine so I agreed to pay 1000 pounds for the whole car. Then I arranged to transport my car to him at a cost of 250 pounds. He then picked up the doner car and got it
to his place where he stripped out the good engine and sold the doner car shell for scrap for 350 ponds. So he had my car there and the doner engine. I did say to him that there was no rush and to take his time. Well for the next two months nothing really happened, we had a stream of what's app messages going back and forth and basically all I got was excuse after excuse that he wasn't doing anything, His mums ill, its too cold, my mates let me down, the parts are faulty, I'm ill etc etc etc. This has gone on now for eleven months and now he barely even reply to me messages, so basically I have told him I've had enough, so he said well come and pick it up. Now to be honest I'm completely lost with what to do, I can't really pick up a car that is in pieces with no engine, So I am about 1250 out of pocket. plus the loss of my car which if running would be about 4k. So by the 14th November next month will be a year he's had it. Any advice as to where I go with this would be great, thank you in advance

    Hi CHASKUS

    Welcome to LB

You've got his name and address, you've verified it's correct.

Send him a letter before action, give him 14 days to do what he said. Send it Recorded Delivery.

If he contacts you, your message is a simple one, he has '14 days', no other dialogue.

If you could arrange for it to be picked up by a local garage, get them to put everything back together with the engine. Pay the garage then take the person to the small claims court for your losses.

Is he in the business? i.e. mechanic, car dealer etc.

In the mean time build your case, Whatsapp messages etc.

How much did you agree to pay this guy for labour and parts to fix your car? Is he going to charge for his labour on an hourly rate?
So far he has travelled to view the donor car, picked up (transported) the donor car back to his premises, removed the engine from the donor car, arranged for the car to be scrapped, plus storage for 2 cars
The repair sounds labour intensive and costly
You stated your car would be worth £4k when repaired. Your mercedes must be an old car and unless you repair it yourself or have a friend to replace the engine on the cheap, beyond economic repair
Have you got anything in writing about your agreement with the guy?

The doner car was just near his. The engine install was agreed at 800.00 plus some parts, timing chain etc. All our chats are on a what's ap trail so every conversation is backed up by evidence. The car is ten years old but really good condition, too good to scrap.
