    Not telling the truth and answering "yes" would risk being charged with contempt of court

      Hang on there
      The claim is not about whether or not the driver used a blue badge, and the use of a blue badge will not be part of the defence.

      The defence will be around the poor drafting of the claim form, the possible poor signage when a copy is obtained (generally its in breach of consumer laws).and breaches of POFA 2012
      No need to go down the rabbit hole about use of a blue badge

        coachaom14 now you have acknowledged the claim you need to send the following:
        i) to DCBLegal a cpr31.14 request & ii) to the parking company a Subject Access Request .

        MAKE SURE YOU DO NOT IDENTIFY THE DRIVER

        Templates for these are to be found in the panel on the right of this page.
        They will need amending for your particular circumstances as they were originally drafted for debt claims so e.g. references to Consumer Credit Act are not appropriate in your case
        If ypou need help, just shout but send them sooner rather than later

          Surely the easiest thing to do here, would be to talk with the travellodge in question, get their written confirmation that you were authorized to park there and that the matter has been resolved, and then forward it to the company chasing the fines.

          If they are using an outside enforcement company but the car park belongs to the travellodge, then this will force the end of the matter, and travellodge custom service sounds like a better bet than a parking enforcement company when it comes to getting a reasonable customer facing solution.


          Normally with big companies if you are a big enough of a pain in the ass in asking for them to do something, they keel over and do it. Not all are like this, but often custom services will step in and even do stuff against company policy, on the basis of it making a happy customer. Seen it happen quite a few occassions.

              That's a shame. I'd still suggest talking with travellodge as they must have some sort of agreement with them for the whole badge thing, unless that is also a completely unrelated part of this story and is a policy to do with the car park itself.

                My understanding from OP's earlier posts is that the BB thing was nothing to do with Travelodge either. The car park near it allowed free parking with BB to all BB holders. Unfortunately OP isn't a BB holder, hence the advice not to mention that use of BB at all in any defence.

                  even if the op was entitled to use a blue badge, forgetting to use it would not have been a viable defence.
                  If pure oversight to do something that was required was a viable defence the parking companies would soon be out of business
