    I help my neighbour who has had 7 brain tumors removed, this has caused him trouble with communicating with people, he gets tongue tied and confused in a confrontational situation.

    Recently a driver crashed into the back of his vehicle, the other party admitted full liability, the vehicle was taken away (50 ml) for repair. when the vehicle was returned he was told he could not have the car back until an excess of £250 was paid. this he did and received a scrawled pencil written receipt.

    My questions are:

    as the injured party, should he have to pay any excess?

    If this was a genuine charge, surely this would have been payable to the insurance company

    If it was genuine, would it not be reasonable to expect the delivery driver to have a proper letterhead invoice.

    Who arranged the repair? Your neighbour's insurance company? If so it is correct that he would have to pay the excess. He can make a claim against the third party for the amount of the excess.

      Many thanks for prompt reply, I am unsure I will have to check with him. However I doubt if he knows as his daughter in Law arranged the insurance and all her details phone/email are used for contact with insurance company. Tried to ask the question but was ignored as I think the telephone number I gave (His) was wrong. Of course his DiL is on holiday and not interested.
