  • Parking fine private land

    I received a parking charge notice for being in private land , the problem I have is that I was not parking , I stopped to check my satnav and had the engine running for 3 minutes and then moved on . There latter states the time being 3 minutes .

    They ignored my appeal and now it’s with a solicitor and they’re asking for details like my employment and wages etc

    what should I do ? I’d like to take it to court as I can prove that I wasn’t actually parked , I was idle for 3 minutes .

    Solicitor's name... DCB Legal?

    Could you please post up (suitably redacted) the documents you have received, and photo of the car park signage if feasible
    I suppose you identified the driver when you appealed.

      The car documents are in my mums name , they told me I was too late to the names driver , my mum is old , with health conditions so it’s stressing her . I will get the letters soon and post them as they are at her house .

          Just out of curiousity the photo looks as if it is a proper public road not private land?

            The road seems to belong to a building company , there are double yellow lines , and a sign on the wall saying private land

              As I said , I pulled in to check my satnav , the engine running and I pulled off a few minutes later

                That's a brilliant claim from Gladstones (are they really a firm of solicitors?

                The sign says "no parking", so it is not possible to contract to park there.

                However Gladstones don't care ... they issue a claim for breach of a contract which never existed!

                Just acknowledge the claim, without entering a defence (that can come later)

                Send Gladstones a CPR31.14 request and to the parking Company a Subject Access Request (there are templates in the SHORTCUTS panel on the right of this page. They will need amending for your situation.. do not blindly copy them)

                Obviously do all this in your mother's name as the claim and PCN were addressed to her.
