  • URGENT: Notice of Intended Prosecution for Speeding received over month thereafter

    Please help...

    I received a letter dated 18/04/24 on 22/04/24, extremely distressed.

    Stating;

    Contrary to regulation 3 of the Motorways Traffic (Speed limit) Regulations 1974, section 17(4) of the Road Traffic Regulations Act 1984 and Schedule 2 to the Road Traffic Offenders Act 1988

    Recorded Speed: 87mph Date (of incident):; 05/03/2024


    Do not understand why a letter was issued over month after the event. Is there are time limit within which it can be pursued? The vehicle is on lease, so it is not owned by myself.

    I would be grateful for any guidance.

    A Notice of Intended Prosecution must be served on the Registered Keeper (i.e. the person or company holding the V5C and whose details are held by the DVLA) within 14 days of the alleged offence. Other than that there are no time limits for any other notification (in fact no other notification is required by law). Since the car is on lease I imagine you are not the Registered Keeper.

    If the limit was 70mph, 87mph is too fast to be offered a course. Instead a fixed penalty (£100 and 3 points) should be offered. If the limit was any lower you will face prosecution in court.
