  • How do you reclaim costs for withdrawal

    Does anyone know how to reclaim costs made, when operator withdraws PCN when a appeal is lodged with POPLA.? For example, postage, 150 pages of printing, time spent on appeals reminders and debt collection actions when the PCN should have stopped being g escalated.
    I am presuming it will need to commence by a invoice to operator and progress from there

    You need to find a basis in law to claim something like this. The closest you will find is wasted management costs but only applies to businesses, not litigants in person. Afraid this is the cost of everyday life and unless you are able to claim under a different head, you will have to suck it up.

    I will say that 150 pages seems to be an extortionate amount of paper to be printing for a POPLA appeal - don't they allow electronic documents?

      Thank you for the reply Rob.....yes it is a lot, copy for me
      And another to the BPA, my statement and appendices included evidence of issuing appeal to operator, letters of reminders, complaints to operator ( all more than once) sar request and reminder, letters to debt collectors to stop action, images ect ect.. Operator started to claim an appeal had not been made , untill my evidence to POPLA to show that was impossible
      I obtained my aim regarding the pcn, but withdrawal to saves embarrassment for the company and with no apology to date.....never mind
      Do the BPA have any teeth when members breach their code of conduct?
