My car went in to a local garage for its MOT last week. Received a call from the owner saying he'd reversed it into the workshop wall damaging the bumper and side panel. He organised the repair with a local bodywork specialist which has just been completed this afternoon.
He gave us a courtesy car in the meantime, however today this broke down. He refused to help with recovery and said it was our responsibility. The breakdown occurred around 60 miles from home and cost us almost £500.
He refuses to reimburse us saying he told us we were liable for breakdown cover. He did not. He only mentioned speeding violations and parking tickets.
Being a local garage, the courtesy car was a casual arrangement. It was not in good order having done over 124000 miles and is dented. We had no option but to use it as my hysband had to attend an important meeting, which he subsequently missed.
I'm looking for advice. I want to try and recover this money as I feel its nothing to do with us. The garage damaged our car, we were forced to take their replacement vehicle in a desperate situation and are now out of pocket. This never would have happened if they'd not damaged our car.
Do we have a case? Is it worth threatening the Small Claims Court?
