In my experience the problem will be getting them to actually provide it. Information such as this often arrives extremely late (sometimes on the day of the trial leading to an adjournment in the interests of justice). As Handyandy says I don't see how it could be on the "unused" side of the material but would not put it past them - which is why you need a solicitor.

Quite. Video footage is rarely, if ever, provided at the SJPN stage and it is often the case that it becomes "unavailable" later on. I always find this a bit disturbing because the defendant is entitled to see what evidence exists in order to form a view on his plea. This is particularly so when the defendant has no real idea what he is accused of (for example, when the likes of "Cycling Mikey" sends in footage of a driver passing him half a centimetre under the recommended clearance).In my experience the problem will be getting them to actually provide it.
I think the important thing to emphasise is that a defendant will rarely be served with everything the police have and they should not build up their hopes that they will.
