    Just recently the gym I am a member in has instructed Smart parking to manage its car parking. There is inside the entrance a tablet and you have to put your registration details in. This then contacts smartparking that you are a member.and parking is legimate. The date in in question 07/08/23 was the date contravention. Date issued 2/10/23.
    which exceeds the 14 day rule.
    can you please advise.

    Can you post up the Notice to Keeper which you have received.

    I expect your response will be along the following lines:

    Dear Sirs,
    I have received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the Notice to Keeper within the relevant period as prescribed by section 9 (5) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

    DO NOT IDENTIFY THE DRIVER
    There my be other failures to comply with the Statute, so check?
