  • VW Emissions Scandal

So I signed up to this court action scheme earlier this year, through a company called POGUST GOODHEAD. Yesterday I received an email stating:-

You will recall that when you signed up to mydieselclaim.com, we asked you if your vehicle was fitted with an EA189 engine. This is because Pogust Goodhead is no longer able to take on clients with claims in respect of vehicles fitted with EA189 engines and so we need to establish that your claim is one which we are allowed to take on. Having validated your vehicle engine type with a specialist third party, we have been informed that your vehicle contains an EA189 engine. This means that we cannot take on your claim.

Now the thing is at the time I said that I didn't know if my vehicle was fitted with an EA189 engine. Because I didn't. Just like I didn't know if it had a 5amp or 10amp fuse protecting my SatNav. Why would I. So, okay. They have checked and found that my car is fitted with an EA189. From the research that I have done this morning, it is vehicles that were fitted with an EA189 engine that are at the centre of the scandal. So, if it follows that EA189 engines are the contentious engine, and my vehicle was fitted with one, why am I being told that they cannot progress my claim. Can anyone explain the logic to me?

The obvious answer is to revert to Pogust Goodhead, but they have no contact number, only a hatbox, that you go round and round in circle. Stating my options are to seek other legal advice. Am I missing some blatantly obvious point?

    Thank you in advance.

I think that that company cannot help because VW have come to an agreed out of court settlement over a class action being brought by Slater Gordon on behalf of 90,000+ clients.
If a they, or another firm organise an other class action you might then be able to participate.
I heard that solicitors "Leigh Day" might be considering such an action, and it might be worth while searching for them

Thanks for the response. Why would they say that because it has an EA189 engine, that there is nothing they can do to progress though, the inference being that if it wasn't and EA189 engine, they could?

Regretfully I don't know the answer to your question
Have you asked them for an explanation?

Google suggests that the class action that DES8 refers to in post #2 was in respect of the EA189 engine and you unfortunately appear to have missed that particular boat.

There is no way of contacting them. The email is a no-reply and their website is a chat bot that sends you in circles.
