  • Parking charge

    Hi

CP plus (private property parking) 2 parking charges received, apparently I should have received 3, the first and foremost never received for £60 only the second for £100 and a third for £170!

Debt Recover 2 letters received apparently I should have received 3.

A 17 min overstay due to a lost bank card of my sister, in her own car. Only noticed that it was missing when paying at the last store Tk Maxx. After store opening times, searching, walking the concourse and entering stores no longer open to the shopping public, enabling us to speak to managers aware of our situation.

A letter signed by 2 stores confirming the reasoning for the overstay, with signatures and phone numbers, yet I’m facing court action, a court action to recover the balance, which could then increase to £235 if unsuccessful in court.

I have offered £60 despite there being a genuine reason for the overstay but have been told by the debt recovery that this won’t be acceptable by Parking charge company, despite them not providing an original letter for £60. My sister never received a first letter either only a £100 penalty, yet no correspondence thereafter!!! despite us both having the same reasoning and supporting documentation for appeal, both of us did appeal -

2 genuine reasons being treated differently!!!

Stressing both myself and my sister out. Apparently I am ignoring letters, I most certainly am not.

Automated reply’s to emails etc with a reply window beyond my penalty duration.

    Please help with advice

So a SAR to CP Plus go flush out any missing notices

What makes you think you are facing a court claim?

Who is actually named on the invoices? You or sister? It's not a fine.

Have you asked the stores to get CP Plus to cancel?

    Debt collectors can be ignored

Thank you, both myself and my sister have a fine, both for £100 but her only receiving one letter, non for the spares you £60.
i have had letters from a debt agency, I have spoken to them and they simply told me to seek legal representation as my debt would be processed for court
We had a letter with signatures from the stores proving we were on site for a genuine reason.

Sorry predictive text…. None for the initial £60 fine.
I guess the timescale CP+ had to issue an initial fine/invoice as I’ve been told the paperwork is, ran over the period of issue, them then submitting the £100 fine/invoice, stating we had ignored the previous, despite it not being received. Both myself and sister

          It's not a fine !!!

I asked why did you think you have a court claim.

So have you sent a SAR ??

So respond to the debt collectors saying yuou dispute the debt and return the matter to their principal

Post up the first letter that was received.

Sister start her own thread so things do not get confusing.

          Post up the signs

The furst letter received and a further debt letter today. I was told by the debt Co over the telephone that i was unable to appeal and that it was noted that I was seeking legal advice in readiness for court….
surprisingly!!!! I have received 2 further letters since.
