    Hi,


    I’ve been a delivery driver for Amazon, via one of its delivery service providers SBL COURIERS since November 2020

    Recently, I’ve had to take a couple of weeks off as I managed to damage my hip and surrounding muscle structure, for which I’ve been to see a doctor and will require some physiotherapy in the next week coming.

    SBL have decided to, today, clamp my van that I hire from them for £210 per week ( even though my “contract” with them says a lesser amount per week) because I’ve been off for over 7 days, and my direct manager now saying that they’re looking at over 4 days in future!

    They’ve held back my remittance payslip for this week (3 weeks in arrears) and not paid me as they have said that the money owed to me on that week is now paying for the van hire for the two weeks off. Still trying to get my head around this as I’m paid 3 weeks in arrears.

    They’ll probably charge me for clamping my hired van even though I wasn’t consulted about this happening.

    Very angry about their attitude and now effectively out of a job.

      What does your contract stay about deduction from wages. If there is a right for the company to dedcut wages is this situation covered?

        find attached my contract.

        as a side note, the van has now been taken by the company and I’m effectively out of work. Without any consultation.

        Clamping my van on a public highway and now removed. Cheers SBL

              Thank you for the contract.

              You are actually employed on a "contract for service" so you are not an employee but a self-employed driver, however having had a quick look through the contract I can see the following:

              * The van expenses as detailed in point 6.1 total £190 not £210 per week.
              * Under point 6.9 you will be charged for the days that the van is in your possession even if you do not work so you will be charged for the van during the period you did not work fand this will be taken from the money owing to you.
              * Did you attempt to let anyone know you were off sick as under point 8 they may have treated your absence as being over 7 days as termination?

              I have removed the contract as it has your personal details in it and this is a public forum.

                Yes, I have written records( WhatsApp/texts) explaining to manager that I’m off sick. Communication was always there.

                I’m now out of work. In physiotherapy for the leg issue.

                on a plus side, got interview for a proper job back in engineering so going for that.

                  There are some contractual points that you can argue not only the van hire but the fact you notified them you were absent due to sickness and therefore not looking to terminate the agreement but I am not sure how far that will get you on this one.

                  I would say that you are doing the best thing to try and find a job elsewhere and would wish you very good luck with that.
