    Hi I’m looking for some advice

    i receive a PCN on the 20/10/2020 relating to a parking charge I got on the 1/10/2020.. it was for staying 20 minutes over the 120 minute parking sty! I chose to ignore this letter as it was out of the 14 day period they have to notify me as no parking charge was left on the windscreen of my car.. I’ve received several letters since, but today I’ve been sent a letter before claim.. what can I do? Can I appeal the claim?

    It was silly to ignore the PCN even if it was outside of the 14 days.

    So you have to respond to the LBC denying any liability for the charge and giving them the reasons. If you could post up the PCN others might be able to add some additional items.

    Your first appeal would have been:

    Dear Sirs,

    I have just received your Notice to Keeper No. xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. In addition you have failed to warn of keeper liabilty in the format prescribed by 9 (2) (f) of the Act nor stated that the driver is liable for the charge as required by 9 (2) (b).

    You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

    Yours etc


    So work out what you have to say.

      I agree was silly but had one previously and it went away.. I’ve attached the first pnc I received

        I've changed the appeal so you can write to the solicitor giving the reasons why you, as the keeper, cannot be held liable
