Update.....we are instructing lawyers to do all this, yes would be lovely to be able to do it ourselves, but cant, i dont have the time, patience or energy, and it has taken time away from us spending time with our children. Thank you so much for all of your help, it has been priceless, you are all angels

Hi thought i would post an update as to where we are now......We have sent all paperwork to National Conciliation Service, which is free for consumers. The garage wanted to use their ADR which both parties have to pay.* There have been a few emails going back and forth, and the garage are sticking to their guns in saying that the Differential is part of an MOT.....so therefore because car has 12 month MOT then it is safe and legal and they dont owe us anything..* *The independent garage who did the 82 point check have today emailed their quote for repairs, using genuine parts as cannot buy them from anywhere else and the valuation is just over £6500.....that is more than we paid for the car.....this garage where we bought car from need closing down.

Thank you, long road ahead still.* I have a friend who is an MOT Tester and he states that DIFF is NOT part of an MOT test, but will get checked if there is evidence of a leak at the gearbox..* We have written to DVSA to clarify this, and if they do then we can respond with Diff not part of MOT test and that is stated by DVSA. The garage cannot then contest that as it is set in stone by Government.* *
