  • Car mileage differs from advert

    Just bought a car advertised in autotrader which I negotiated price by phone and bought in my name. My husband collected the car and returning home 300 miles I have noticed there are an additional 6000 miles on the clock which is £800 value difference! I only do 6000 per year and feel as if I've lost a year already. Where do I stand legally?

    This would be dependant on the contract between you and the seller, did they state the different mileage in the contract, orally, or in the advertisement for the car?

    If the seller deliberately mislead you on the mileage then they would defiantly be liable for misleading in respect of goods and services.
    Even if not deliberately*a seller has an obligation *to carry out due diligence to find accurate mileage if stating this to a purchaser, so if they accidentally stated the wrong mileage they could still be liable. *

    Either way, legally, if they could be shown to have mislead you whether by accident or not, you could have a claim.*

      You purchased the car solely relying on the description and your husband only took delivery after purchase?
      If that is correct you would certainly have a claim for breach of contract as the goods do not match the description.

      Consumer Rights Act 2015 sec 11 Goods to be as described
      (1)Every contract to supply goods by description is to be treated as including a term that the goods will match the description.

      Your remedies vary from complete rejection to receiving a price reduction
