  • VCS claiming CCJ against me

    I have been ignoring letters as per many others for car parking fine where I was 1 min 17 seconds over the 2 hour limit in a shopping precinct car park. They have now sent a letter saying Elms legal will be calling at my home if I don't pay £275. It was my belief this is bullying and harassment as they cannot force you to pay. Now they are worrying me. Do I have to pay this money?

    Do they actually have a CCJ against you, ie did you receive and ignore court forms?

    Ignoring has not been recommended for some 7 year

    You would have had a very good chance on an appeal as you were well within the grace period they are required to give by their Code of Practise

      No official court forms, just threatening letters but now they say they have a ccj against me and quote a claim number F7QZ21EP and that ELMS Legal ltd have been instructed to contact me directly, although they haven't yet. They want £275 within 10 days. I followed advice that they can't make you pay because they are not council.
      it's lots of scare tactics which isn't nice. However I need to know if I should pay.

        You could apply for the judgement to be set aside on the bais that you did not receive the claim forms and then respond to the claim and defend it.

        What do you expect for official court forms? They are not awe inspiring.

        Contact the small claims court and ask about that case number.
