  • letter of indemnity vs car insurance certificate

    we have a letter of indemnity from the insurance company covering us for the time in question but this is in-lieu of a valid insurance certifcate

    are there any previous cases where an indemnity letter has been presented in court to answer a charge of driving without insurance ?

    and if so what happened ?

    Hi and welcome

    Normally if you obtain a letter of indemnity from your insurers it is sufficient to pop along to your police station and show them.
    They pass it along and the case is dropped.
    There is no point in them allowing the case to proceed because you can demonstrate the insurance was in force.

      I thought that but the police have charged and we now have a letter asking us to plead

        So you had insurance but no certificate and the insurers have supplied a letter of indemnity ?
        How did this problem arise? Did the insurers fail to issue a certificate of insurance?
        The insurer’s obligation to indemnify in contract would be unaffected by a failure to issue and deliver a certificate, notwithstanding it might technically be a ground for criminal prosecution for driving/using an uninsured vehicle.
