  • How to challenge insurance settlement figure

    Hi, I’m looking for some help regarding my insurances offer on what they class as a write off to my vehicle.

    A couple of weeks ago my work van van was involved in a police chase and damaged. After having to independent garages out, they both estimated around 2-3k worth of damage which is easily repairable and in no way a write off. Eventually after many phone conversations where I was told the van was a write off before they had even seen the vehicle, the insurance company sent out their own assessor, and lo and behold, the vehicle was a write off with a lot more damage. I spoke with them and told them I had found other independent garages who were willing to take on the work for much cheaper but they didn’t want to know. The assessors report doesn’t match up to the garages which I have had round to asses the damage.

    I have since been offered a figure for my vehicle, which in my eyes doesn’t match current market value. I have sent off to the insurance company similar vehicles for sale at a higher value but again they say that they don’t need to offer a figure which would allow me to buy a like for like vehicle? Is this correct?

    They have told me that they are not willing at all to budge on their offer, but there must be something I can do. I know I can speak with the FOS but I don’t know where to start - does anybody have an advice at all? It seems as though they would rather pay out much more writing the vehicle off than repairing it, whether that’s for their financial gain once salvaged I don’t know.

    Hi and welcome

    Insurance is a contract of indemnity which means it should put you back in the condition you were before the loss.

    Regarding this incident, how was the vehicle involved in a police chase / was it stolen?
    Presumably the peeps responsible for the damage aren't in a position to pay for it.

    Can you post a link to your policy wording please, or name the insurers and type of policy?
