Received a claim? Yes
Issue Date: 23/1/19
Have you Acknowledged the Claim?: Yes
Total Amount Claimed : £240 approx
Claimant’s Name: National Car Parks Ltd.
Solicitors Firm: BW Legal
Original Creditor:
Original Debt : £100
Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ): amount claimed approx £170, court fee £25, Legal costs £50, Total approx £240.
Is the debt Statute Barred (have you had any contact with the creditor or claimant over the last 6 years?): Letters received from NCP and BW Legal regarding fine. I did not respond to these.
List any letters you have sent (eg: CCA/ CPR ): None
Any Other Information or Background Details:
I parked and paid for 2 hour's parking at the machine (by entering my reg. no.). I spent a couple of hours in the town then rushed back to the car as I was conscious of the time. I was 5 months pregnant, with a toddler and with my elderly mum. We got back to the car a little late and as I didn't see a ticket on the windscreen I didn't hurry to leave the car park.
I later received a letter from NCP for a £100 fine for overstaying the time limit by 11 minutes. There is a photo of my car entering and leaving the car park (although the people inside cannot be seen).
Do I have a defence? Any help would be greatly appreciated!
