VT excess mileage - please help.

Hello All,
I did VT of my PCP contract with BMW Finance in September. Couple weeks later I had their invoice for excess mileage in the post. After my replay that I don't accept this charge.BMW replied with another letter saying that excess mileage is pre-termination liability and is payable under section 99 of Consumer Act. Also they said that I can send a dispute case to FOA if disagree with this.
How would you recommend to proceed now? Thanks a lot! .
