    I love the last bit, "The Appellant claims the driver did not leave the site, but as the driver is not identified I cannot give any weight to this claim."

    Well my response is, "Excel claim the Appellant/driver left the site, but as they have not provided any evidence of this action, I cannot give any weight to this claim".

    I honestly wouldn't try to play semantics about who it was, Appellant or driver or keeper, the point it the person who parked the car is said to have gone off site, and if not the keeper, then its the driver, and it's that THEY must prove.

      Thanks, LATICSFORLIFE, the parking company seems to think that if their parking attendant signs a statement of truth to say that the driver walked off the site, then that's all the proof they need in order to win their case.
