    Hi i have received a notification of enforcement agent visit on 24-11-2015. I was at work and my mrs she did not answered the door and someone dropped a letter through my door. " Notification of enforcement agent visit" fr Bristow n Sutor enforcement agency.
    Its about council tax i owe from my previous address. No one entered my house just dropped the letter it says " as an enforcement agent i have attended your premises today with the intentio of taking control of your goods in accordance with the taking control of goods fees regulation 2014. At this time tour goods are bounf. You cannot remove.sell or otherwise dispose of them.
    I was paying them weekly 30 pound as i am working part time sometimes i do have work sometime i dont. I had missed a payment for week my current balance was 90 pound left and they have put 235£ fee .
    i rang bristow n sutor they said because u missed your payment and now have to make new arrangment to pay 325£ in total including 235£ enfircement stage fee. When i asked her i didnt receive any letter or email before agents visit she said we do not need to send you any letter or email before agent visit as yiu missed out on payment and agreement was broken therefore we do not need to send you any letter before an enfircement agent visit.
    I asked her i can pay my remaining balance of 90£ now and dont want to pay 235£ fee which she said i have to pay. I already have paid nearly 600£ towards my debt there was 90 pound left now they charging me 235 £ .
    what are my options here please someone help.

    Bailiffs must send you notice prior to coming, I think 7 days? so whatever the person on the telephone has said is incorrect. Complain back to the council and explain they have failed to send you a notice of enforcement, You have already made payments of £600 and there is only £90 remaining which you can pay off now. Hopefully they should accept the final payment from you and recall the bailiffs.

      Adding to what [MENTION=71570]R0b[/MENTION] said ... as the bailiff didn't enter the house, nothing inside has been 'taken control' of, only what was outside

        What has happened is correct, you must go back to when your agreement was initially started. I do believe however they have seen an opportunity to garner fees. Did you advise them you were not going to pay that particular time? Do you know when you first stated paying this?

          Hi Rob thanks alot for your reply.
          yes the only notice i received was this letter is notification of enforcement agent visit on
          24-11-2015 time 18:46 pm. And it was delivered by the agent.
          He never entered my premisses and there is nothing outside that he can take control of.

            Hi i think i started paying in july no i didny advise them that i cant pay for a week. I just spoke to the council and they said they can not do anything i will have to speak to the bristow n sutor.

              At the beginning you would have received a Notice of Enforcement - Compliance Fee for this was £75 - asking you to pay or make an offer of payment which was obviously successful. It should have been explained at that time that should you default then the Enforcement Fee of £235 would be triggered should a visit be made.

              In your shoes because you only had a small amount left to pay I would contact your local Councillor(s) and see if they will intervene on your behalf.
