    Hi Guys could anyone tell me where I can find the following online: Council Tax (Administration and Enforcement) Regulations 1992

    I ask because I'm due in court this month for non payment of council tax, and after writing to my council disputing the £85 summons costs I was told

    "
    All costs are agreed with Bradford Magistrates Court and are in line with all other local authorities"

    I don't believe that (although I may be wrong) it is the job of the council and the courts to decide how much the charge would be, but that the law states that councils are only allowed to charge reasonably incurred charges. According to the telegraph Bradford Council only incur a charge of £1.22 per reminder. http://www.telegraph.co.uk/comment/c...on-a-year.html

    These are the Regulations: The Council Tax (Administration and Enforcement) Regulations 1992

    Specifically Regulation 34(5)(b):

    (5) If, after a summons has been issued in accordance with paragraph (2) but before the application is heard, there is paid or tendered to the authority an amount equal to the aggregate of—

    (a) the sum specified in the summons as the sum outstanding or so much of it as remains outstanding (as the case may be); and

    (b) a sum of an amount equal to the costs reasonably incurred by the authority in connection with the application up to the time of the payment or tender,

    .....
    Cost to the council is £3 per application for summons.

          if you feel the court has not acted properly, then it is open to you to make a formal complaint to HMCTS Correspondence, Complaints and Litigation Unit. I am currently assisting a CT payer to pursue a complaint against an MCC, two JPs and a Clerk of the Court in connection with CT.
