    If a baillif has gained peacefull entry can they still come back if your in talks with the council about a payment plan.

        Yes, and if you do not let them in they can use a locksmith, at your expense.

        if you are discussing a payment plan with the Council, they (the Council) should tell the bailiff to put a hold on the liability order, but the Council should not really discuss the issue with you since they instructed a bailiff to act on their behalf, they (Councils) do it all the time and then they (Councils) wonder why they get done for breach of contract.

          Did the bailiff use any threats in order to gain entry to your home or did they claim they had to gain entry and obtain a levy in order to set up a payment plan? Strictly speaking, both tactics can come back and bite the bailiff - and local authority - on the bum.
