  • Advice needed please.

    It's a long story but I will give you a little bit in the hope you understand.

    Suffer and suffered with anxiety, depression, eating disorder and stress since 2000 and haven't worked since a major breakdown and hospitalisation.

    husband had a business and stupidly I signed the 'partnership' details

    Husbands business went down the pan and he did a moonlight flit abroad in feb 2008

    i was shocked and still very ill and had no knowledge of problems or debt, had no income and buried my head in the sand.
    Stayed in the house getting by (house owned by husband) made bankrupt in 2009 although I haven't as yet completed the process due to illness.
    evicted from house in 2010.
    During the time from 2008 I had little spurts of energy to try and sort out the debt and one of those was my council tax, I had numerous telephone calls with the council, I told them that I needed a discount as I was on my own and they asked me to put it into writing which I did and I also gave them details of a possible address for the ex, I then received a letter saying that they didn't believe me and they were still chasing me for full payment.
    I phoned and they called me a liar, I have since asked for a copy of those conversations and they say they have no record of me contacting them but do have a copy of the letter they sent me.
    I am now living with a new partner and trying to get back on my feet and for the first time since 2000 am no longer on medication while I am building my confidence etc.
    I receive no benefit as my partner is earning although I was on ESA with no payment and now working with them to get me back to work and have just signed on to JSA with no payment.
    The council again have started on me again threatening bailiffs, the problem is that I have no money, I don't earn any money, I don't own anything and I think the shock of someone ie a bailiff attending the house will send my partner mad... he is so good at his own finances. I moved into his home, with his things and not sure what to do now.
    The only other debt I have is utilities also from previous address from 2009 to 2010

    Can anyone help please as the last thing I need right now is to go back down to where I was.

    Apart from possibly suggesting that you chase up what happened with your bankruptcy, as that should remove the problem(s) of your earlier debts, it could be worthwhile getting your partner to swear a statutory declaration that none of the goods and chattels in his home belongs to you. Make copies of that declaration and, should a bailiff turn up, hand a copy to the oaf.

      Thank you for that, will the council continue to harass me forever or will it just be passed onto one bailiff then another. I just need to be prepared for what's about to come, I have contacted the council and let them know my situation and although they say they have noted my comments they haven't come back with anything else. I am currently using email to contact them so they can't call me a liar again and then deny it, I still find it strange that they can't find all my previous correspondence with them and should I later be in a position to pay then I need the debt reduced.

        Your CT from before your bankruptcy should be (or should have been) included in the debts you had.

          unfortunately the bankruptcy was in 2009 and these debts are from 2009 to 2010 when I left the property, I had contacted them with my bankruptcy details at the time and again reminded them that I was on my own but they still insisted on charging me for 2 people going forward, I then buried my head again as I felt that the extra cost was too much to cope with and tbh I wasn't still thinking straight.

            Then you need to work through the council's complaints procedure before, if needs be, taking it to the Local Government Ombudsman (link)

              I would also suggest you go to CAB armed with the forms from this link:

              I have used this for clients many times and the entire debt has been written off - it's a bit of a convoluted process, but can be worth it in the end.

                thank you so much, I have just looked at the 2 letters they sent me and one was for an LO nov 2009, if my bankruptcy was may 2009 would that debt more than likely be covered by my bankruptcy? I had told the council in 2009 that I was made bankrupt and sent them details and again told them I was on my own and would like the discount which they refused to acknowledge.
                The second LO was granted August 2010 and is for an amount a lot smaller than the other. phew.

                  Thank you Labman, I have always stated to the council that I had a problem, under doctor and hospital and also was classed as an 'at risk adult' for a period of time but they just refused to acknowledge anything and just called me a liar and kept threatening me with bailiffs, I just want to get better now and make a new start, I will have a look at all of that later. thanks again
