    Hi all,

    Thanks for taking the time to read this.

    We completed on our home in January and have kept the flat we were renting while the messier works on the new house are carried out (electrics, windows, doors, new heating system, etc).

    I was told yesterday that we must pay double council tax for the house we bought as it was empty for over 12 months before we bought it.

    I wasn’t aware of this weird rule (I probably should have checked), but when I suggested that I move into the house while the renovation works are done while my partner keeps the flat, I was all but told I was be committing some kind of tax evasion.

    It’s being eating away at me since. It’s our home and I’m being told I can’t live in it? Yes I would be doing so to mitigate tax liabilities, but since when did that become a crime?

    so could anyone advise whether I am within my rights to do so?I would effectively have a bad, a TV and my personal possessions and would genuinely live and sleep there every night until my partner is ready to join me. I work on the house most evenings anyway, so it makes little difference to me where I rest.

    Any advise at all would be sincerely appreciated. I truly hate this government and all the little ways they create to take more and more from normal working people!

    Can you name the council please as council rules can differ in detail.

    I'm not sure if this will be relevant but are you and your partner joint tenants in the flat you rent and have you bought the house as joint owners?

      Hi,

      Thanks so much for responding.

      the council is Allerdale (now Cumberland). The flat is in my partners name only in the tenancy as it was her flat and I moved in 12 months ago.

      The mortgage on the house is a joint mortgage.

      If I went ahead and moved into the owned house, we would still be paying 100% council tax on the flat as my partners son lives with us - and the council tax on the house would be 75% as single occupancy. Not sure if that last part is relevant, but just in case.
