  • Enforcement process commenced

    Hi All,
    I hope you are well.
I have received this letter from some debt agency XXXX & XXXX.
They claim that I owe ~£300 to to the council.

In the letter in Enforcement Details it says "Liability order dated <over a month ago>. in respect of Council Tax owed...."
I pay tax month by month and no electronic communication from the council about any outstanding tax then this pops in the mail.
There was no letters regarding this or a court case for this order unless they can just do it in the background without notifying anyone.

    Does this make sense?
    This is madness.
    Please advise.

Have you taken this up with the council?

Is this the same council tax liability as discussed in your previous thread, or a new one?
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

      Hi Atticus,
Thank you for checking my history as it is possible I experience a memory hole due to relatively hectic life as you can imagine.
The old thread about CT liability was with a difference council and this has been resolved before escalation.

I have checked the letter for possible scam but it has links to website of a legitimate enforcement agency.

I have not contacted the council yet as I wanted to seek some advise first.
I just don't understand how come the council has systems in place that they can harass me and it supposed to be me to call them up and explain things.
If this is some system error of theirs this can be explained over the phone but if the communication was broken deliberately by some corrupt employees at the council I think I should speak to a solicitor/lawyer first?
At least make sure all the calls are recorded.

In the past one of my friends has been scammed by one of the councils in London what turned out to be some corrupt people working there taking advantage of others and overcharging/double-charging him.
From his testimony he didn't give in and in result they had to backtrack and I think they eventually dropped the demands or returned the money however there wasn't any criminal proceeding.
My impression of all of this was that they targeted people whose English is not the first language (they could figure this out from surnames and some other data they had) so the victims were more likely to give in.

I am going to contact the council however from the other response I got it is likely that the council will just fob me off and redirect to the enforcement agency as this is with them now.
I think I will have to contact the councilor to intervene in the matter.

      Thank you

I double checked the mail I received in recent months as I put everything in one place but no letters from the council about the liability.
On annual basis they send me an email with a PDF with the CT Bill. I also have electronic receipts I pay the tax using their payment portal.

I have called the council and it looks like there is some outstanding debt from last year but this does not reflect on the CT bill I received on the 9th of March 2024. I just pay monthly the amounts stated on the schedule.
According to the council they sent all the letters beginning April 2024 and consider them delivered.
Apparently it all comes from a hub and happens automatically. I have not received any of them but the one from the enforcement agency who uses a different system and at least have enough paper in their printer.
It baffles me how did they manage to get the liability order without me knowing anything about the proceeding but just now.

Someone suggested to contact the councilors listed at writetothem.com but I don't know if I should write to the district ones or country councilor.

Write to the people who are members of the council that is taking the enforcement action.

I just send them a very polite message using the writetothem.com system.
              Let's wait and see.
