  • £10k CT Demand on an unregistered property on a working Farm - who is liable?

    Hi,

    My pensioner in-laws have lived in separate converted stable block within the demense of a working dairy farm for 7 years. The property appears to have been converted originally to holiday lets around a decade ago, but a planning search reveals that no planning permission was applied for and the property was never registered with the VOA, so no council tax bill.

    The property also does not appear to have a separate land plot so is still part of the business area of the Farm. In-laws do not work for the Farmer.

    Their assumption (dangerous word, I know) was that the property was rented from a resident landlord who lives in the main Farmhouse 40 metres from the Stables.

    However local council have done an inspection and discovered the property and done a temporary assessment at band C, and sent a backdated a bill for around £10k, but going from a date from before the In-laws moved in.

    So, the VOA will be coming and presumably find no Title Number to value and things get messier.

    So the tricky question is where does liability lie and to what proportion between the in-laws and the farm owner?
