  • Jacobs demanding daft amounts.

    Im a full time student with five children, one who is disabled and my partner gets carers allowence for. Ive been told that 50 pound a month for an outstanding council tax bill for an old address isnt enough. I have this years council tax bill to pay at over 100 pound a month for my current address and another two outstanding waiting to be paid with jacobs too. Ive sent an expenditure form to them and they have told me i can cut back even more. I dont have any luxuries or go out much. I have a car but i live in a remote village with no bus service so this is my only way to get the kids to schools and bus stops and my self to university. But there insisting i dont need a car. Im getting very worried now as im on medication for depression and have been for the past 15 years and im concerened its all going to get out of hand.

      Hi, I’m not sure on the advice this group would suggest as I am new myself but didn’t want to read and run and hopefully somebody would correct me if I am wrong.

      I wouldn’t deal with the baliffs at all! I would make sure my doors were locked all the time and wait it out till they send it back to the council (which they do do eventually) st this point you can get in touch with the council and they are much more reasonable when it comes to payment plans.

          They are more likely to send it to another Enforcement Co. Most Councils use 2 or 3 different ones.

            How much do you owe and how many Liability Orders are there against you? Were you a full time student previously at your old address?

              Yes i had an attachment of earnings when i was claiming income support at 20 a month. Till one is paid then the next one falls into place. But since ive gone back to uni they have said i know have to pay a minimum of 100 pound a month as they say i can sell my car as i have it as a " luxury " and i can save money by "selling my dog as thats not a necesaty item. They have only started throwing there wieght since the income support stopped. The same things were happening with the previous two at my old address i just couldnt keep up the unaffordable payments

                And the 100 a month is on top of my current 125 a month council tax and the extra im having to add to my rent

                  Its the liability order with the same council as the current debt.

                  If so, copy the head of finace ( 151 officer ) at your council into the refusalse and there request to sell your dog and car. Did theysay thaton paper btw.

                  collecotrs will; spout any sh***t they can regardless of the appropreatness of it. Your 151 officer is bound by rules, rules around accounting principals.

                  Tell ( in writing,email ) Jacobs, that your unable to afford the ammounts there demanding and the offer you made and they rejected was the maximum you could stabley afford. That you insist that the account is sent back to the council as they would havce to acsept the offer ( they would ).
                  crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

                    yes its all with Hambleton district council, the same as my current property council tax. no it was said over the phone so general threats with no proof sadly.

                      On top of what CC has said you should also contact your local Councillor(s) and ask they intervene on your behalf https://www.writetothem.com/ - best initial contact is by phone. I don't doubt Jacobs will deny what has been said to you but I'd be tempted to wind them up by telling them you have a recording of the phone call. Have you actually had to submit an I&E? Have you had a visit from them and if so have you had an explanation of any fees they have charged?

                        From what you say in the original post you should be classified as a "vulnerable" debtor for a variety of reasons, low income, disabled child, suffering from chronic depression.

                        Things that need doing:

                        A) Get medical evidence about you and your child, photocopy and email both the Council and Jacobs.

                        B) See if you can register your car as an "invalid carriage" for the benefit of your child, if you can you just caught two birds with one stone: 1) they can not take the car, 2) your VED is £0.00

                        C) Just in case B doesn't work get evidence that there are no buses serving your location and how far the nearest bus stop is to take you to places like Doctor's Surgeries and food shopping.
                        If Jacobs insists that you can do without car because you can take taxis instead provide proof of how much per week you would have to spend on taxis, think of your movements over the past 2 weeks and compute.

                        D) Fill in another Income and Expenditure form, the only income you don't have to enter is your child benefit (that's the child, not yours), but do include your partner's carer's allowance and any other income which is either not regular or only paid a few time per year (such as income from Solar Panels or the use of "green" equipment used to heat your home or dispose of waste water) when you compute the available surplus income offer 33% of it to the new Liability.

                        Please be aware that neither the Council nor the Enforcement Agency will consider entries for TV subscriptions, besides the TV licence and excessive broadband charges, and if your children are old enough to have a mobile phone those costs are not going to be allowed.
