  • Is this right I'm paying council tax for my ex husband

    Hi all, I was married in 2000,but my name was never put on the house, I left my husband in 2009,the house got repossessed a year or so later. I went on benifits and then got council tax bill for the old house, the council told me they couldn't find my ex so I had to pay, and do they been taken money out of my benefits for last 9yrs I only work as a carer so not loaded. I never got anything from the house sale, and was told by the ex that al debts had been paid off. I'm still paying now for this property which went even in my name and I left in 2009.is this right? Thank you for any info

      Assuming it's in England or Wales.

      S9 of the Local Government Finance Act 1992 would make you jointly liable whilst you were resident, regardless of the fact that you were not named on the deeds. From the date you ceased having your 'sole or main residence' in the property (and you had no intention to return) then you cannot be held liable for any charge due from that point as you are not a joint owner of the property.

      For any period in which you are jointly liable then the council can pursue you rather than your husband for any unpaid council tax if they so wish.
