    And the second part "...so we already had the CON29M mining report"?

    I am asking these questions as I am trying to understand the full factual position, so as to be able to form a view whether you have a case to be looked into that the solicitor may have been negligent.

      sure, sorry- the mining report we already had. It was a recent report done by the seller

        The impression I have is that you paid roughly what the property is worth in the circumstances. If you sell now, what will you have lost - include conveyancing costs, stamp duty, Stamp Duty etc.

        There may be negligence in not reviewing the mining report and advising you. You will need to be very clear - what would you have done if you had been given that advice?

        You have not answered my question in post #13 whether when instructing your solicitor you informed him/her of your plan to sell the property quickly for a profit. This will affect the level of damages a court might award.

        NB to pursue a professional negligence claim you will need to commence court action. I do not think that the Legal Ombudsman will deal with complaints of professional negligence.

          yes,we have txt evidence that the conveyancers were aware that we will be selling for a profit. so the the legal ombandman can fine up to 50k for losses

                It does sound like something the Ombudsman should look at. If a mining report was already available and your solicitor didn’t read it or flag the risks, that may be viewed as poor service. The Ombudsman will usually want to see the report itself, your conveyancing file and any emails showing you relied on their advice.

                Compensation varies but people do sometimes get losses covered when a solicitor has missed something major. It won’t be quick, but it’s worth raising formally if you think their mistake is what put you in this position.
