  • Unadopted road

    Hi I live in a new build have done for 4 years the road however is unadopted and on the original plans we had a grassed garden to the front of our property, on completion we discovered the site manager had put in a tarmac footpath infront of our home instead of grass we questioned this and his responce was o I had to do a bit of a footpath somewere to keep highways happy, over the last 4 years we have had more and more problems with other residents and non residents parking on the pavement directly outside our property onto out boundaries, we contacted our local councillor who came down looked at our boundaries and said yes indeed the pavement is part of our boundary. Contacted highways on our behalf who notified us the road was unadopted we were not aware of this until this time and that we were responsible for any damage done to curb stones pot holes in the road directly outside our home and as we are a corner plot the road and curb stones we are responsible for is quite a large area, we have put no parking signs up asked people not to park there as it is our boundary however they come and bounce up the curbs day in day out several vehicles blocking access to our front door making the "footpath" inaccessible anyway for any one with a wheelchair or pram as they are parking 2 ft away from our side fence. We have asked advice from our local councillor as this is our boundary could we take up the tarmac and grass the area at our cost as is the case with the house on the opposite side which is the same as ours should of been on the original site plans, she is unsure legally if the highways were to adopt it (they are in dispute with the site builders have been for the last 4 years) were we would stand if we did turn it to grass to stop ongoing issues for ourselves legally if it was adopted eventually would we be forced to turn it back to a path which is on our boundary.
