  • Professional negligence?

    After suffering a TBI in a RTA son bought house outright from compensation. He bought house in joint names with his then fiance. Got married 2 years after house purchase and marriage failed 4 years later. Did the solicitors he used for house purchase have a duty of care to advise him to consider obtaining a deed of trust?

    I doubt it.

      Your son should write to the solicitor to complain about the lack of information provided at the time to make an informed decision regarding ownership of the property
      If he is unhappy with the solicitor's reply he could refer his complaint to the Legal Ombudsman
      If the house was bought with 100% of your son's money, it was a big financial risk to buy it as joint tenants with his fiance. The solicitor should have explained the risk to your son
