  • Upper and lower maisonette do not share lease

    I am currently in the middle of purchasing a ground floor maisonette which is leasehold. However I have discovered that the upstairs maisonette does not have a lease (I don’t think it has been sold in some time as I cannot find a listing).

    this means the lease is defective as there is no obligation for them to contribute to maintenance costs. My solicitor says an indemnity policy will get around this, and the risk is not that high other than dealing with the practical aspects of I needed to claim. I am not as convinced as this could make the property harder to sell in the future?

    my advice is to walk away from this. It is an expensive mess waiting to happen.
