  • Indemnity Insurance for Positive Covenant

    Is it possible to get indemnity insurance for breach of a positive covenant? I know it’s positive but there is a chain of indemnity also so am i correct in thinking this means the covenant does run with the land/ the burden passes on?

    Previous owners didn’t declare this breach but i’m assuming it will be easier to sort an indemnity insurance than any form of legal action?

    A google search suggests that such cover may be available.

      The google searches i completed referred to it as ‘restrictive covenant insurance’ which is why i wanted to clarify positive covenant insurance. I just wanted to check that it was possible.
