  • Scotland - Bushes maintened by Factors on my land?

    I live in Scotland. I have an odd shaped garden layout but in particular there is a triangle part to the side of my house which has a fence seperating the back garden to the front (there is a pavement then road on the other side). On the outers side of this fence there is a large patch of land to the pavement and on this are bushes. These bushes are maintened by the factors. However, I recently checked my title deeds to see my property boundary (red boundary, also shown in pink) and noticed that the bushes are actually shown as being within my red and pink boundary. Surely this is not right? Classed as a mutual maintened area? There is no mention in the deeds. My plan was to just go ahead and remove the bushes and move my fence (it is not a joint boundary fence) but thought against it. Next thought was to just inform the factors about what I have found, give them notice, then remove bushes. My thinking was if the argument is that it is indeed mutual area then why are they not cutting my front lawn as that is with the boundary too! Any thoughts of what I should do?
