  • Chancel Repair Liability

    Hi.
    I am( was) about to exchange on a property in Warwickshire.
    A last minute Chancel Repair Search CRL ( recommended by the surveyor) has established that the property is subject to a possible CRL charge by the local parish church.
    I have been offered a bespoke in perpetuity insurance ( £1m) but the policy as I understand has limitations.
    I have sought an answer to my question but my legal team cannot/will not answer.
    My question is:
    Is the church legal entitlement to claim monies from homeowners ( whose land is defined by chancel repair liability ) restricted to repairs only to the chancel area of the church or does the church have a legal right to compel the homeowner to fund all other areas of repair of the church as they deem necessary/required?

    My anxiety is that the limitations of any indemnity policy I might purchase will not cover the full liability if it extends beyond the chancel area? Forgive my crass analogy but the insurance offered as I understand it is akin to only have 3rd party fire and theft when fully comprehensive motor insurance is required?

    I understand that your own explanation is correct. The Chancel Repair Search is not restricted to the land that you own but extends to the full extent of the chance repair duty.

    The clue is in the "chancel repair" liability term.

      so in lay speak, even if I have a chancel repair indemnity policy i might be liable to any other repair to the church?
