  • Protecting investment in a house

    Hello all. I would be grateful for any advice / experiences in this area. Offspring wants to buy a house (his first one). We would have to pay most of the cost (no mortgage complications - it's cheap!). He is in a relationship (unmarried) and they would live there together. I am wondering how best to protect my investment? Should we do a formal loan agreement and put a charge on the deeds (assume we can do this?). I would assume in the event of a breakup the money would have to be repaid to us before any argument about how to divide the rest of the stuff? They may be happy for just my son's name to go on the deeds which hopefully would also help the situation? Any thoughts

    I have dealt with this type of situation a number of times. The loan and charge arrangement works well.

    dslippy may have further thoughts.

      If there is no commercial mortgage, the right (and simple) thing to do is to have a charge registered against the title to represent your interest.

      That leaves the day to day management of the property where it should be - with your son and his partner.
