We're trying to buy a house with leased solar panels. The vendor's solicitor has been unable to make contact with the company. (The original installer has been bought up by another company). We have no direct contact with their solicitor, so I don't know how hard they've been trying, but it has been going on for some weeks, and is the last remaining issue to resolve. I also tried to contact them months ago for some general discussion about whether there would be an option to purchase the panels outright, but received no response.
The issue came up as an enquiry about whether the panels were MCS compliant. I'm not sure if that is an absolute showstopper, or whether its something we could just take a view on. I think the mortgage company would insist on MCS, but could we avoid the issue as a cash purchase?
Since they have a charge on the property, is it actually impossible to complete a purchase without their co-operation?
