  • Fish pond constant flowing waterfall / feature Noise complaint

    Neighbour has water feature on there large fish pond I need to open my window at night I have recently had Corona virus and need the window open the water feature on ther pond is turned up and is a nuicence to me at night I have to visit the toilet three times in the night and I can't get any sleep how do I stand on the legality of this I recorded Over 63 decibels noise level how acceptable is this I don't want to cause a stir with them they have there bed at the front of there house downstairs so it obviously doesn't affect them in 5he day time it doesn't sound half as loud would you consider this as a reasonable complaint surely they can put the pump lower into the pond so it wouldn't make much noise it is literally driving me insane the time is now 4.21 am and as I said I haven't slept because I need to have the window open because I am a vulnerable person because 8 have asthma and a rare condition of permanent hay'fever and it is dangerous for me at this time with Corona virus which I am into my last hours of isolation I don't normally complain but the noise has.bern going on for years they are not the type of neighbours you can complain too if it was the other way round she would be down our town hall straight away what do you suggest as I need the window open at night especially in the summer months

    That's not great.

    You can complain to environmental health department at your local council. They can investigate your complaint. They can make recommendations to your neighbour.

    There is no good reason to have the water feature operational during the night (just my thoughts).

      Yes there is, to keep filtering and sterilising the water for the fish

          Done 24 hours a day. Turning a filter system off and on gives problems

                Would the noise of water flowing over a waterfall actually constitute a nuisance ? We have a pond and the water runs (lightly and fairly gently ) all the time through the summer , just over a small stone waterfall, but it never occurred to me this could constitute a nuisance ? Surely it would have to be quite loud to even be considered as such? However, this has got me thinking - we are often disturbed during the summer nights by the overnight constant running of a neighbours hot tub ( cheaper to heat it overnight ?) It's a dreadful drone from about midnight onwards and because we are in a very quiet village away from main roads, it is very noticeable. So I can see one mans meat is another's poison ! I shall be interested to read further comments on this one.
