  • Is a freehold reversion specifically to do with a lease?

    Hi, I have had some particularly bad advice and service from my solicitor while purchasing the freehold of my house which has cost me a lot of money.
    Long story short I contacted my home insurer to see if I could take legal action against the solicitor as I had opted for Family legal protection (expenses) as part of that insurance.
    My insurer refused as a clause in the policy it says

    We don’t cover claims arising from or relating to:…
    • leases, tenancies or licences to occupy land or buildings …
    • professional negligence in connection with any matter not covered under this section (Section 4).

    My contention is that it did not relate to a lease as such. I don’t think I will get anywhere with this, has anyone any advice or thoughts on the above?

    You can take the case to the Legal Ombudsman. I did once - suffice to say I did not get other than an apology but you may have more luck! Have you used the solicitor's complaint procedure? That is always the first step.

      I have gone through the procedure 1st complaining to the solicitors practice (waste of time) then with the financial ombudsman about the insurer not covering this, they think it is to do with a lease so agree with the insurer.
      I also have a complaint with the legal ombudsman, its still waiting to be delt with from may/june this year, I'm pretty sure I'll get no compensation through them.
      Its fairy obvious they have made mistakes that have cost me a lot, I was thinking no win no fee professional negligence but there are so many I'm not sure about that, any advice would be welcome.
