We are interested in a landlocked property. The Forestry Commission own one end of the access. The owner has an agreement to pay 70% of the upkeep at that end. The other end is privately owned and the owner informed us she has had problems in the past and all is okay now. The property is an equestrian livery business and the owner built the house and established the business 17 years ago.. Any ideas how we can legalise the situation before purchasing? Thank you

An easement may be created of necessity.Â*Thus a parcel of land will have a right of way of necessity over a road, track or path leading to it if that route is the only means of access between the public highway and that parcel of land.

I think we have decided to not raise the issue and hope for the best.
The track has been used for seventeen years by the vendor so it only needs another three years.
The house and livery business, which was passed by the council, is landlocked and the access only has an agricultural easement.
We most probably would easily attain residential easement but the equestrian easement may be more problematical.
