    Hi all,

    My lease says the lessee agrees -

    'not to keep or permit to be kept any bird dog or other animal in or upon the flat which may cause damage nuisance or annoyance to the lessees or occupiers of any other flats on the site or to which an objection shall be notified by the lessors or other lessees'

    Does this mean that the lessor or lessees can object without grounds or does the dog actually have to be barking etc?

    My reading is that you may not keep any animals that may cause a nuisance. So you may be limited to fish and stick insects.

      Thank you for that Are you being serious? I googled the definition of nuisance and it says

      '
      A private
      nuisance
      is when the plaintiff's use and enjoyment of her land is interfered with substantially and unreasonably through a thing or activity'.

      So the dog has to cause a substantial issue?

          But a substantial issue would have to be, for example, barking that was clearly audible in the other flats? A neighbour couldn't say they just hate dogs and dont want one in the building?

                Many apartment owners are against the fact that they would have someone living with a dog. I am personally against this state of affairs. I have a dog. But she never barks in the apartment.

                  I have a dog. It's a cocker spaniel. I've been renting an apartment for about six months. When I moved into the apartment, I negotiated with the owner of the apartment living conditions. For her it was a matter of principle that my dog would not bark or spoil furniture. My dog doesn't bark for no reason. Sometimes she can squithe if something scares her outside the door. That's how we learned how to behave at home. My dog is still a puppy. She's less than 1 year old. And it is clear that she wants to play. I listened to the advice of veterinarians on how to train a puppy so that he did not spoil things.                     There is often a problem in animals that they can often damage furniture, wallpaper or walls. The animal in the apartment is fine, until they don't spoil the property.
