  • Is there any such thing as shared land?

    We are buying a house that has in its leasehold a portion of its rear yard which is "shared land". But it is not crystal clear who owns it due to a v poor drawing. Is there any such legal thing as 2 owners sharing land or is this just another way of saying shared acces to a bit of land that 1 person will own?
    any ideas?

    Is this registered land, and have you searched Land Registry: title register and plan sections?

    Landshare is not uncommon ie owned by A but used by B&C but joint ownership is also possible

      Thanks but are these legal wordings? Eg "landshare"?. Yes we have searched the land Registry and we do have the plans, the problem is the wording in the leasehold says shared land but shared access on the plan showing which shows shared access land being owned by A and used by a and b. But the wording in the leasehold says shared land and not shared access. Another complication is the drawn plan of the property was clearly wrong when it was submitted so the wording is important, so could you direct me to any information about shared land and legal implications of that? Googleing doesn't show up much information if any.

        To be clear what I am saying is our conveyancer is not sure if this land Is shared ownership i.e. we both own It or if it is shared access i.e. one person owns it and two people share it

          Really this is something your conveyancer should be able to sort.
          Does your use of the term "conveyancer" imply (s)he is not a solicitor?

          You refer to "a V poor drawing"... unfortunately Land Registry boundaries are only general unless they are determined (https://www.gov.uk/government/public...0-supplement-3)

          The wording on the lease states "shared land" but on the plan it is shown as "shared access"
          What practical difficulties, if any, arise from this, other than perhaps liability for maintenance?

            Hi. Thanks for your help . The conveyancer is a solicitor . We negotiated a price based on buying 100% of the land we were told belonged to the house but actually we coukd be buying 95% instead .plus, if a new owner ofbthe adjacent house decided that thry wanted to put up a fence on their land but allow us sccess they could. .. unless it was shared ownership i guess. Nothing is clear!

                Have you asked Land registry if they can clarify.? Their contact forum is excellent and they answer queries very quickly.
