    Hi! I really hope someone could help me with a very tiresome issue.

    We bought a flat last year, and the physical marking of our designated parking space didn't accord with the Lease plan. The incorrect markings meant that I would only be able to access my space by driving through a brick wall! The owner of the parking space next to me was rather disgruntled at my arrival, as it seems he'd been enjoying my parking space as well as his own for some considerable time.

    When my flat purchase completed, the discrepancy between the ground markings and the Lease plan was resolved by the managing agent, who marked the correct parking spaces with gold studs. Unfortunately, the other owner has taken it upon himself to make my life as difficult as possible by deliberately parking across my (now correctly marked) space (ie: still parking as if the ground were incorrectly marked), thus blocking my access. He's also been verbally abusive about it.

    He now states that he wasn't notified aabout the change of the markings by the managing agent (the Lease says they must give notice of any works etc). All leaseholders have a share in the management company and we have an AGM coming up in a couple of weeks, and I really want to be prepared for everything he's planning to dish out. Does he have a point about not being notified of the parking bay correction?

    Any help you can give would be greatly appreciated. Thanks.

    1. Tell the managing agent about his blocking your access, and ask them to take all necessary actions. That may include sending him some sort of notice. Not your problem what they do, as long as they resolve the issue.

    2. Your neighbour may have some complaint to raise at the meeting about the managing agents. Again, not your problem.

    3. Your neighbour's parking space is determined by the lease. That the lines were drawn incorrectly is very reprehensible. He can raise that at the AGM, too. Again, not your problem.

    4. You can raise at the AGM the matter of your neighbour parking in your space, but it's better to get the agent to sort this out prior to the meeting.

      Thank you so much for responding. Something that really concerns me is that the managing agent (a local estate agent) isn't exactly effective and the management company is made up of a mixture of directors (basically owners who also have an interest because some of their parking has been adjusted to allow them to park more vehicles) and, as such, if everything reverted back to the delineation on the deeds, it might impact them as well. A lot of them are standing down anyway because of the grief.

      All I want is to have access to my parking space, without driving through a wall! The troublesome owner of the parking space next to me periodically removes the temporary gold studs that the managing agent recently put down to show my proper parking space, and his wife has told other residents that they're going to get rid of them one-by-one and that, if they sell their property, they'll remove the whole lot. Clearly they're petty, unreasonable people and the cost of rectifying this will impact on other residents. It seems we're already unpopular enough!
